Consumer Health Data Privacy Policy

LightWeight Inc. (the "Company") provides fitness services that necessarily involve information about your body and exercise. Some United States laws, including Nevada's consumer health data law, treat this kind of information as "consumer health data" and require a dedicated policy describing how it is handled. This policy does that. It supplements the Privacy Policy; where the two overlap, this policy governs consumer health data.

1.What consumer health data we collect

  • Body measurements: gender, height, weight, birth year, and exercise experience
  • Workout records ("Workout Data," as defined in the Terms of Service): workout dates and times, exercise methods, exercise volume, sensor measurements and values derived from them, movement trajectory and speed, and exercise evaluation scores
  • Analysis results: muscle-performance and workout analysis, including analysis generated with artificial intelligence (AI), and workout plans based on it
  • Facial recognition (biometric) data, where you have separately consented to it; it is handled under the Biometric Data Policy & Consent

Guest workout records are collected anonymously, in a form that cannot identify you, and are not consumer health data; they are described in Section 7 of the Digital Exercise Equipment Usage and Safety Notice.

2.Sources

We collect consumer health data from you directly (information you enter at sign-up or at a kiosk), from the Digital Exercise Equipment and its sensors as you work out, and by deriving it from the data above through analysis, including analysis using AI.

3.How we collect it and why

  • We collect and use consumer health data to provide the services you request: recording your workouts, showing and analyzing your performance, generating and revising workout plans (including with AI), connecting you with a Partner Center you choose, and issuing session reports.
  • We collect it with your affirmative consent, or to the extent necessary to provide a product or service you have requested.
  • We also use it, in de-identified or minimized forms where possible, to improve the Service, for example by analyzing exercise characteristics and improving the quality of AI analysis.
  • With your separate opt-in consent (the Personalized Advertising Consent), we analyze your Workout Data and usage records to select personalized offers and promotional messages for you. We do not share consumer health data with advertisers.

4.Sharing: categories, recipients, and purposes

  • We do not sell consumer health data.
  • Service providers (processors) process it on our behalf under contracts that limit processing to our instructions: our facial recognition provider, which processes Biometric Data only; our cloud infrastructure provider; our equipment distribution and installation partners in the Republic of Korea, which receive workout and equipment-status information for the Partner Centers they serve; and AI providers in the United States, which receive minimized Workout Data and body measurements with direct identifiers removed. Our analytics provider receives no consumer health data. The current list is published on the Third-Party Service Providers page.
  • A Partner Center (such as a gym, rehabilitation facility, or clinic) and its Trainers receive your workout-related data only when you link your account to that center in the app and give a separate consent naming that center. The structure of this sharing is explained in the Consent to Share Personal Information with Partner Centers, which you accept at sign-up. Sharing stops when you unlink.
  • We may disclose data where required by law or valid legal process, and as part of a business transfer with notice to you.

5.How your data is processed

Consumer health data is processed electronically, using automated processing that includes AI-based analysis. It is transmitted to and stored on secured servers in the Republic of Korea; AI analysis involves transmitting minimized, non-directly-identifying data to United States–based AI providers, as described in Section 6 ("Transfers to AI and Analytics Providers in the United States") of the Privacy Policy.

6.Your rights and how to exercise them

You may, at any time:

  1. Ask us to confirm whether we are collecting, sharing, or selling your consumer health data
  2. Request a list of the third parties with whom we have shared it
  3. Direct us to stop collecting or sharing it
  4. Request that it be deleted
  5. Review your data and request that it be corrected

To make a request, contact us at contact@lightweight.run (or through customer support in the app). We will verify your request and respond within 45 days. Where you request deletion, we delete the data within 30 days of verifying the request; copies in archived or backup systems are deleted within the additional period applicable law allows. Exercising these rights never results in discrimination in how we serve you.

If we decline a request, we will explain why, and you may appeal by replying to our response; we will review your appeal and answer in writing. If your appeal is denied and you are a Nevada consumer, you may contact the Office of the Nevada Attorney General (ag.nv.gov).

7.Third-party tracking

We do not allow third parties to track your consumer health data for their own purposes. Our apps use Google's Firebase analytics for service usage and crash diagnostics (device and app-usage information, not your health data), as described in the Privacy Policy, and we do not use advertising identifiers for targeted advertising.

8.Changes to this policy

When this policy changes, we will announce the change on this site's Notices page before it takes effect (at least 30 days in advance for material changes and at least 7 days in advance for other changes) and update the effective date shown on this page. Collecting or sharing consumer health data beyond what this policy describes requires your new affirmative consent.
