Digital Exercise Equipment Usage and Safety Notice

This Notice explains how to use the Digital Exercise Equipment (the "Equipment") of LightWeight Inc. (the "Company") safely. Read it in full before using the Equipment.

This Notice applies to everyone who uses the Equipment, including guests who have not signed up for membership. By starting to use the Equipment, you agree to this Notice.

WARNING: To reduce the risk of serious injury, read this entire Notice and the Frame's instructions before using the Equipment. Failure to follow these instructions may result in serious injury.

1.Definitions and Intended Use

  1. "Drive Unit" means the device that creates and adjusts exercise resistance through the rotation of a motor, together with its accessory devices such as the tablet. The Drive Unit is the Company's product, manufactured and supplied by the Company.
  2. "Exercise Equipment Frame" (the "Frame") means the exercise machine body designed or built to hold or house a Drive Unit. Frames come in several forms, including conventional pin-loaded (weight stack) machines retrofitted with a Drive Unit in place of the weight stack, and complete machines purpose-built for this system. Some Frames are made by the Company, and others are made by third parties, such as exercise equipment manufacturers and partner companies. The manufacturer and supplier of each Frame, and its instructions and precautions, are identified in that product's labeling and manual.
  3. "Equipment" (Digital Exercise Equipment) is the name for the complete exercise machine you work out on: a Drive Unit combined with a Frame. Calling the combination by one name does not change who made each part; responsibility is allocated part by part under Section 6.
  4. "Service" means the software provided through the Equipment's tablet, which offers convenience features that support your workout, such as automatic recording and real-time information display.
  5. "Manager" means the operator of the facility where the Equipment is installed and anyone the operator has tasked with managing the Equipment.
  6. The Drive Unit is a device that assists exercise, and the Service is software that assists exercise. THE DRIVE UNIT AND THE SERVICE ARE NOT MEDICAL DEVICES and are not intended to diagnose, treat, cure, or prevent any disease, nor to prescribe any treatment.

2.Your Safety Responsibilities

  1. Exercise itself carries the risk of injury, including muscle soreness, strains, sprains, and bruises. Stay aware of this and use care at all times.
  2. Read and follow the Frame's instructions and precautions as well.
  3. Before using the Equipment, know the proper form, the appropriate resistance (weight) range, and the appropriate training volume for the exercise you intend to perform.
  4. The exercise guidance the Service presents (exercise selection and order, tempo, form, weight and repetitions, difficulty, rest times, equipment usage instructions, and the like) ("Exercise Guidance") is only an aid to your workout and may not fit your actual situation. Always give priority to the guidance of the Frame's manufacturer, the fitness facility, your Trainer, and other qualified professionals.
  5. Consult your physician before beginning this or any exercise program. If you are injured, ill, or otherwise not in good health, or if you have a condition that requires medical caution, such as cardiovascular disease, high blood pressure, or pregnancy, do not use the Equipment without the approval of your physician or another qualified professional.
  6. Before exercising, check that the Equipment is properly set up and operating; if something is wrong, do not use it.
  7. If you notice a problem while using the Equipment, such as abnormal operation or a warning message, or if you cause a problem yourself, stop using it immediately and tell the Manager.
  8. Children, older adults, persons in frail health, and beginners require particular care and must use the Equipment only under the supervision of a qualified professional.
  9. Always maintain proper form and control while using the Equipment, and do not overexert yourself.
  10. Stop exercising immediately and tell the Manager if you feel faint, dizzy, or nauseated, or if you experience pain, chest discomfort, or shortness of breath.
  11. Keep your hands, hair, and loose clothing away from the cable, the cable reel, and other moving parts. Do not let go of the handle while the cable is extended; return it under control.
  12. If power is interrupted, the resistance may change suddenly, and the cable may retract automatically when power is restored. Release the handle safely, and do not pull on the cable until the Equipment resumes normal operation.

3.Prohibited Actions

Do not do any of the following.

  1. Disassembling, modifying, repairing, or reverse engineering the Equipment without authorization, or copying, altering, hacking, or misappropriating the Service
  2. Connecting other devices to the Equipment through its USB port, AC input connector, Bluetooth, or other wired or wireless connections
  3. Using the tablet for personal purposes such as web browsing, games, or video playback; changing its settings; closing the dedicated app; installing or running other apps; or bypassing its security by rooting or jailbreaking
  4. Anything that could compromise the Equipment's mechanical or electrical integrity, such as striking it, blocking its vents, splashing water on it, or bending its power cord or wiring excessively
  5. Attempting resistance, speeds, or ranges of motion beyond the specified limits, or otherwise using the Equipment abnormally
  6. Putting continuous load on the Drive Unit, such as holding an isometric position under load for one minute or longer, or pulling the cable out and securing it in the extended position
  7. Using the Equipment for anything other than exercise

4.Prohibited Environments

Do not use the Equipment in the following environments. Doing so risks degraded performance, malfunction, breakdown, electric shock, or fire.

  1. Environments outside the allowed operating temperature and humidity ranges. If the Equipment carries its own labeling for these ranges, follow that labeling; otherwise the ranges are 14°F to 140°F (−10°C to 60°C) and 20% to 90% relative humidity, non-condensing.
  2. Environments where liquid can splash or seep into the Equipment, including condensation
  3. Environments with excessive dust or salt, explosive gases, flammable materials, or corrosive substances
  4. Environments with strong vibration or impact, electromagnetic interference, or static discharge
  5. Environments with potential electrical problems, such as current leakage (ground faults), overcurrent, poor grounding, overloaded power strips, or aging outlets
  6. Environments where the power supply does not match the voltage, frequency, and power rating marked on the Equipment. Rated power, voltage, and frequency vary by product line and by the country or region of sale, and are shown on the rating label attached to the Equipment and in its manual.

5.Abnormal Equipment Conditions

If the Equipment is in any of the following conditions, stop using it immediately and tell the Manager. Continuing to use it risks accidents and injuries from malfunction or breakdown.

  1. A warning message is displayed in the status bar at the top of the Service screen or in a pop-up
  2. The Equipment makes abnormal sounds or vibrations, or emits smoke
  3. The cable that carries the load shows signs that it may break, such as frayed or broken strands or a damaged end fitting or attachment clip
  4. The Equipment's resistance output is inaccurate or fluctuates
  5. The Equipment is unresponsive or responds slowly
  6. There is, or appears to be, current leakage (a ground fault)

6.Allocation of Responsibility; Assumption of Risk

  1. YOU KNOWINGLY AND FREELY ASSUME THE RISKS OF EXERCISE AND OF USING THE EQUIPMENT. These include the inherent risks of resistance training (muscle soreness, strains, sprains, bruises, and more serious injuries) and risks specific to motor-driven resistance equipment, such as changes in resistance during a movement, sudden changes in resistance if power is interrupted and automatic retraction of the cable when power is restored, the movement of the cable and other moving parts, and losing your grip, balance, or control under load. Injuries and losses that occur during exercise are generally your own responsibility. In particular, the Company is not responsible for accidents caused by your failure to follow the safety responsibilities above, by prohibited actions, by use in prohibited environments, by your continued use of the Equipment after an abnormal condition became apparent, or by carelessness, inexperience, or your health condition.
  2. The Company is responsible, as provided by applicable law, for losses caused by malfunctions or defects in the parts of the Equipment the Company manufactured and supplied (the Drive Unit and Company-made Frames) or in the Service, and for losses caused by the Company's negligence or willful misconduct. Nothing in this Notice excludes or limits liability that cannot be excluded or limited under applicable law.
  3. The Company is not responsible for accidents or losses caused by the characteristics, defects, breakdown, or malfunction of a Frame the Company did not make. For those, contact the Frame's manufacturer or supplier, or the Manager.
  4. Be aware that using the Equipment involves the risks of injury described in this Section, and take care of your own safety.

7.Guest Use

  1. Guests (Users who have not signed up for membership) may use some features of the Equipment without logging in, within the scope the Company designates.
  2. Workout records generated during guest use are collected anonymously, in a form that cannot identify who you are, and may be used for exercise analysis (including AI-based analysis) and for statistics on the use of the facility where the Equipment is installed.
  3. Because guest workout records are collected anonymously, it is impossible to later find, review, or delete any particular person's records.
  4. To save and manage workout records as your own, sign up for membership (including creating a Temporary Member account) and log in.

8.Camera Notice on the Login Screen

  1. On Equipment that offers Facial Recognition Login, the tablet's camera operates on the login screen and automatically captures an image when a face is detected close to the screen.
  2. Captured face images are used solely to compare them with the registered facial templates of Members who have separately consented to Facial Recognition Login and registered their face. Face images of anyone who has not registered, including guests, are not stored and are deleted immediately after the comparison.
  3. The camera's feed is not recorded or retained.
  4. If you prefer not to use facial recognition, you can log in by other means the Company provides, such as Member Number Login.
  5. The Equipment is not intended for use by children under 13; keep children under 13 away from the login screen while the camera is on.

9.How You Agree

  1. The Service's start screen presents this Notice as a summary with access to the full text, together with the buttons for starting to use the Equipment, and states that starting use means agreeing to this Notice, so that you agree by your own affirmative action.
  2. By tapping a start button and starting to use the Equipment (including use without logging in), you confirm that you agree to this Notice and are responsible for following it.
  3. The Service's start screen provides a button to view this Notice in full at any time, together with an explanation of how you agree to it.

10.Relationship to Other Documents

  1. This Notice is an Operational Policy established by the Company under Section 9 of the Terms of Service, and applies together with those Terms. Matters not addressed in this Notice are governed by the Terms of Service.
  2. The Terms of Service also apply to guest use, to the extent applicable, and the matters most important to guests (anonymous collection of workout records and the operation of the camera) are explained directly in Sections 7 and 8.
  3. The handling of Members' personal information is governed by the Privacy Policy.
